LEGAL TERMS FOR PARTICIPATION IN THE DRAW

1. ORGANIZING COMPANY OF THE PROMOTION

 

The company Synergy WorldWide Europe Management Services Spain, S.L. with address at Moll de Barcelona s/n. North Building, 2nd WTC. Barcelona 08039 and identified with tax ID B87553061 organizes the draw (hereinafter, "the Promotion") with a European scope, to be carried out through the Internet, exclusive to users residing in Europe in accordance with the participation requirements section. The purpose of this draw is to reward the loyalty of the brand's followers.

 

 

2. START DATE AND END DATE

 

The Promotion will start on [November 17, 2023, at 16:30 pm], and will end on [the 23rd day of November at 11:59 pm]. The company reserves the right not to carry out the promotional action if by the indicated start date there are not more than 100 registrations.

 

 

3. PARTICIPATION REQUIREMENTS AND PROMOTION MECHANICS

 

The participation requirements are as follows:

 

• Those residing in Europe and over 18 years old can participate.

• Only participants who own an Instagram account can participate.

• Participants must comment on the brand's post on the Instagram social network, tagging 3 friends during the participation period.

• Participants can only participate with a single Instagram profile. If it is detected that a participant participates with multiple Instagram profiles, they will be disqualified.

• The application will accumulate mentions and hashtags from the same participant even if they are in different comments.

 

 

4. PROMOTION CONDITIONS AND PRIZES

 

The winner will be chosen randomly through the InstaSorteos platform. The winner will be announced on November 24 through the brand's social profiles, along with the draw's validity certificate. The prize will consist of a discount code of 100 euros (or the equivalent in the national currency). The prize cannot be exchanged for cash or any other prize, nor can it be subject to change or alteration. The company reserves the right to modify the prize if, on the day of declaring the participant as the winner, there are stock problems and, therefore, impossibility of providing the same. The winner can contact the company within 2 weeks from the date it is announced on the brand's social profile. If no contact is made within the stipulated period, the draw will be declared void, or another winner will be assigned, according to preference. The celebration of the draw, as well as the awarding of the prize, are subject to current tax regulations.

 

 

5. DISQUALIFICATIONS AND PENALTIES

 

If it is evident that any of the participants do not meet the requirements specified in the Terms, or the data provided for participation is not valid, their participation will be considered null, and they will be automatically excluded from the Promotion, losing all rights to the prizes awarded under this Promotion. The company reserves the right to declare the draw void.

 

 

6. PUBLICATION OF COMMENTS OR OPINIONS

 

Comments or opinions whose content is considered inappropriate, offensive, defamatory, or discriminatory, or that could violate the rights of third parties, will not be allowed. Comments against an individual that violate the principles of the right to honor, personal and family privacy, and one's own image will not be allowed. We will not be responsible for the damages caused by the comments made by participants in the Promotion, which may offend the sensibilities of other participants at any time. Participation in this Promotion, as well as the publication of comments made by participants in the posts, must not, under any circumstances, violate Instagram's Community Rules or Instagram's Terms of Use. If the company discovers the use of fraudulent means for participation, such as the use of bots in comments, the prize will not be awarded, and it will remain the property of the company.

 

 

7. LIABILITY EXEMPTION

 

For illustrative purposes, but not limited to, we are not responsible for possible losses, thefts, delays, or any other circumstance attributable to third parties that may affect the development of this Promotion, as well as we are not responsible for the participant's use of the prize obtained from this Promotion. We do not assume responsibility in cases of force majeure or fortuitous event that could prevent the realization of the Promotion or the total or partial enjoyment of the prize. In case this Promotion could not be carried out, either due to detected fraud in it, technical errors, or any other reason that is not under the control of the company and that affects the normal development of the Contest, we reserve the right to cancel, modify, or suspend it, including the participation website.

In accordance with the provisions of the General Data Protection Regulation, each participant, by accepting these Legal Terms, consents to their personal data being included in a file owned by it, for the purpose of managing the draw, as well as disseminating and advertising its results, and processing the prize delivery. We inform you that you can exercise your rights of Access, Rectification, Deletion, Opposition, Limitation of processing, Portability, forgetfulness, and not be subject to automated individual decisions by sending an email to marketing@synergyworldwide.com.

 

Without prejudice to any other administrative recourse or judicial action, the participant will have the right to file a complaint with a Supervisory Authority, particularly in the Member State in which he has his habitual residence, place of work, or place of the alleged infringement, if he considers that the processing of his personal data is not appropriate to the regulations, as well as in the case of not being satisfied with the exercise of his rights.

 

For this reason, the participant declares to have been informed of the conditions on the protection of personal data, accepting and consenting to the processing.

 

 

9. CHANGES AND ACCEPTANCE

 

We reserve the right to modify or expand these promotional terms, as long as it does not harm or impair the rights of the participants in the Promotion. The mere fact of participating in the draw implies that the participant fully accepts the conditions of these Legal Terms. Likewise, participating in a draw of this nature implies the acceptance of the rules of the Instagram social network through which it is carried out.

 

 

10. APPLICABLE LAW AND JURISDICTION

 

These legal terms will be governed in accordance with Spanish law. The courts and tribunals of the city of residence of the participant will be competent to resolve any claim or dispute that may arise in relation to the validity, interpretation, or fulfillment of these terms.
